MEMBERSHIP TERMS AND CONDITIONS
THE VALUE OF MEMBERSHIP
- Access and use of the office space.
- Regular maintenance of the office space.
- Heat and air-conditioning in the office space.
- Electricity in the office space.
- Furnishings for Private Office Memberships.
- Use of kitchen and beverages made available to our members.
- Access to and use of wireless and hard-wired internet.
- Access to printers, copiers and/or scanners.
- Access to conference rooms; subject to availability and prior reservation.
- Amenity hours are given to Private Office Memberships. These Amenity Hours will not roll over each month.
- Acceptance of mail and deliveries (Depending on your membership level)
- Opportunity to participate in members-only events and promotions.
- OUR RESERVED RIGHTS
Access to Offices. We are entitled to access your Office Space, with or without notice, for safety or emergency purposes or for any other purposes. We may temporarily move furnishings contained in your Office Space. We reserve the right to alter or relocate your Office Space, provided that we will not do so in a manner that substantially decreases the square footage of your assigned Office Space or related amenities.
Video Surveillance. NuvoDesk may conduct video surveillance of any portion of its premises at any given time, with the exception being private restrooms. The video cameras will be positioned in appropriate areas within and around the NuvoDesk building and used to promote the safety and security of all Members and Property. You must consent to such video surveillance to be a Member or an Event Client.
Access Prior to Start Date. If we provide you with access to your Office Space for any period of time prior to your Start Date, during such period you and your Employees/Staff shall be fully subject to the terms of this Agreement, regardless of whether we choose to charge you the Membership Fee during this time.
- YOUR EMPLOYEES
Member List. You are responsible for maintaining the accuracy of your list of Employees on the NuvoDesk Member Portal. Only those individuals included on the Member List will be deemed to be “Members”. It is not permissible to go over capacity of chosen Office space; however, any additional occupants are required to obtain a Shared Desk Membership to gain 24/7 access to Premises. We reserve the right to further limit the number of Members allowed at any point.
Changes to or Removal of Primary Member. The Primary Member has the sole authority to make changes to or terminate this Agreement. A Primary Member will serve as NuvoDesk’s primary contact regarding matters that involve your Members and the physical Office Space. We will be entitled to rely on communications with the Primary Member as notice to or from the applicable Member Company.
- CONDUCT OF MEMBERS
Keeping NuvoDesk tidy is a requirement in maintaining a quality workspace. Work areas, as well as food and lounge areas, are expected to be kept clean and presentable. This means cleaning up after yourself in your desk area, as well as the dining area by grabbing a disinfectant wipe and wiping down areas that you dirty.
- No food of any kind should be left in your office overnight or over the weekend. All food related trash items should come to the kitchen trash cans. All Private Offices may take their trash liners to the large trash cans located in the East and West Stairwell. Do not exit through the stairwell doors as they will lock upon your exit.
- Any pest control problems arising from noncompliance with these rules can result in the member incurring a charge to rid the office space of such pest. If this does occur, you will receive an invoice from the pest control company so that you know the exact monetary obligation.
- Please be mindful that some foods have a certain odor to them. We ask that conference rooms be kept free of these types of foods. Sandwiches, chips, cookies, and any food that does not cause a distinct odor will be acceptable in the conference room areas. Drinks are allowed in the conference rooms.
- We ask that no one eat food in the lounge area due to risk of stains to furniture. Please eat at the dining room tables. If there is no space there, we ask that you eat at the shared desk area.
- Any food stored in the fridge should be labeled with your name and date.
- Shared refrigerator will be cleaned each Friday and items not taken away will be thrown out. All Tupperware will be stored for Member retrieval.
Members shall not keep or store candles in their private offices. Candles present a huge fire hazard; and due to NuvoDesk Coworking not requiring its Members to possess an individual insurance policy, we ask that all Members abide by this rule. Space heaters of any kind must be approved by staff. If granted permission to have one in your Private Office, it is mandatory to shut it off daily. If you forget to turn off your heater, you are subject to a $200 fine.
Members must be mindful not to disturb the noise environment, or any specific member of the environment. This is a coworking space. We expect our members to make efforts to recognize the needs of others, and a balance should always be sought to recognize the needs of one, while not hindering the needs of another.
Any member consuming alcoholic beverages must do so in a responsible manner and be of legal drinking age. If a Member or Member’s Guest becomes intoxicated, NuvoDesk reserves the right to ask that person to leave the premises and call the Arlington Police Department if the need arises.
All members are expected to abide by the Anti-Harassment Policy stated below.
Harassment of any kind shall never be tolerated and should always be considered as an “in the eye of the beholder, not the person delivering the message” environment. We fully understand that personal relationships have extended parameters and privileges, but we must also maintain a sense of security for all those entering NuvoDesk. Therefore, our policy strictly prohibits the following:
- Offensive comments related to gender, gender identity/expression, age, sexual orientation, race, religion, disability, body size, and physical appearance
- Sexualized or otherwise inappropriate images and hateful speech (including in presentations)
- Deliberate intimidation, stalking, or following
- Harassing or unwanted photography or recording
- Inappropriate or otherwise unwelcome physical contact or sexual attention of any kind (i.e. unwanted hugs, playing with hair, or touching pregnant bellies)
- Sustained or intentional disruption of talks or events
- Question, comments, or actions without empathy. (We expect all words and actions to be rooted in thoughtfulness and conducive to growth)
- Any other harassing, abusive, or derogatory conduct
- MEMBERSHIP FEES AND PAYMENTS
Payments. NuvoDesk Coworking will only reserve a Private Office five (5) business days prior to move in. Upon submitting a signed Membership, you will be required to pay in full to NuvoDesk the Refundable Damage Deposit (if applicable to that membership). as well as the first month’s Membership fees.
Dues. NuvoDesk can set up recurring payments via ACH or credit card (subject to 3% fee each month).
Failed/Late Payments. If a Members payment fails for whatever reason, Member will be automatically prompted 4 times before their membership is downgraded to Community Member. If payment is not received by the final email prompt, Member access card will be deactivated and NuvoDesk will seize any property of the Member. If payment is not received by the 30th, Member will then be responsible for miscellaneous fees listed above including (access card key, cabinet key, office key, any other outstanding charges that may have been accrued i.e. printing fees). Upon payment, items may be returned that were seized; however, it will be NuvoDesk staff’s sole discretion to allow Member to continue membership with NuvoDesk. It will also be NuvoDesk’s sole discretion to allow previous Member to do business at NuvoDesk with other members. All late fees are subject to increase from time to time at our sole discretion.
Upgrade/Downgrade. Members can upgrade with only a 24-hour notice if availability exists. Members may downgrade their Membership Agreement with at least a 30-day notice. Any upgrades or downgrades will start a new Membership Agreement with new terms as well as loss of any concessions (specials) that were on previous Membership Agreement.
Invoices. NuvoDesk will provide invoices and other billing-related documents, information, and notices to the Primary Member via their membership portal.
Miscellaneous Fees. The Member is responsible for all issued dongles, access cards, cabinet keys and any other borrowed equipment/property. The Member is required to return all such equipment after use. If issued property has been lost or stolen, the Member is responsible for informing NuvoDesk staff immediately and pay the following per item:
- $300 for Dongle (computer adapter)
- $50 for Access Card Key
- $150 for Office Key (If Applicable)
- $120 for Lockable Filing Cabinet Key (If Applicable)
- $200 fine for prohibited fire hazards in Private Office areas (i.e. candles or prohibited space heaters left on overnight)
- Pest control invoices that are directly related to a Member’s office cleanliness will be passed on to the Member; however, NuvoDesk does pay for pest control treatment.
Credits; Overage Fees. Each month, some Memberships will receive a certain number of credits for conference room and/or golf simulator use. These allowances may not be rolled over from month to month. If these allocated amounts are exceeded, you will be responsible for paying fees for overages. All overage fees are subject to increase from time to time at our sole discretion.
Form of Payment. All prices are cash based. ACH is the preferred method of payment. All credit cards are subject to a 3% service charge. You are required to update any changes to your payment information via your membership portal.
Outstanding Fees. Any outstanding fees will be charged in arrears monthly. When we receive funds from you, we will ﬁrst apply funds to any balances which are in arrears (including any outstanding late fees). Once past balances are satisﬁed, any remaining portion of the funds will be applied to current fees due. If any payments remain outstanding after we provide notice to you, we may, in our sole discretion, withhold Services or terminate this Agreement.
Payment Returned. Upon rejection of any card charges or personal checks if your card issuer or its agent or affiliate reject such charges and or seek return of payments previously made to NuvoDesk Coworking, LLC. when NuvoDesk Coworking, LLC. believes you are liable for such charges; a $50 non-sufficient fund or NSF fee will be due within 24 hours after being notified via certified funds (i.e. cashier’s check, money order, or cash). If payment is not received, your access to the building could be revoked until payment is received.
No Refunds. There are no refunds of any fees or other amounts paid by you or your Members in connection with the Services.
NuvoMarket Place. NuvoDesk provides Member’s access to the kitchen facilities. Additional beverages, food, and miscellaneous items may be purchased through a POS system using the “Honor System.” The Member must pay for items they take and any failure to do so will result in immediate suspension or possible termination of this agreement.
Business logos. Logos are added to the glass doors of Private Office Members who intend to stay a minimum of 6 months or longer. Member must provide logo in vector format. If Member does not have their logo in vector format, there will be an additional fee set forth by NuvoMarketing Group. Any Member that cancels their Membership for any reason before their 6-month anniversary will be charged a $150 logo removal fee.
- TERM AND TERMINATION
Term. NuvoDesk Coworking provides Members with plenty of flexibility such as signing month to month Memberships all the way through 36-month Memberships.
Termination by You. You may terminate your membership by providing a written 30-day notice. You must provide proper notice in order to receive refundable deposit (if applicable), so long as there is no damage to your Office Space.
Move In / Move Out. If the Start Date is a Regular Business Day, you may move into the Office Space starting at 9:00 a.m. on the Start Date, provided you have complied with the payment obligations. On the last Regular Business Day of the Termination Effective Month, you must vacate the Office Space no later than 4:00 p.m.
Termination or Suspension by Us. We may withhold Services or immediately terminate your membership: upon breach of this Agreement by you or any Member, if any outstanding fees are still due and Member refuses to pay (i.e. suspension/termination could be enforced if items such as printing remaining outstanding after we provide notice to you), and/or if you or any of your Members fail to comply with the terms and conditions of the NuvoDesk Membership Terms and Conditions, or our Wireless Network Terms of Service (located on the last page). Any monies paid to NuvoDesk at the time of termination will be deemed nonrefundable.
Refundable Deposit. (if applicable) The Refundable Deposit will be held for performance of all your obligations under this Agreement, including the Membership Fee Obligations, and is not intended to be a reserve from which fees may be paid. Should you owe us other fees or payments, you may not depend on deducting them from the Refundable Deposit but must pay them separately. We will return the Refundable Deposit, or any balance after deducting outstanding fees and other costs due to us. Such fees could include damage to any furniture, carpet, glass, or common area property. Deposits are returned within thirty (30) days. Return of the Refundable Deposit is also subject to your complete performance of all your obligations under this Agreement, including full satisfaction of your Membership Fee Obligations and any additional obligations applicable following termination or expiration of this Agreement.
Removal of Property Upon Termination. Prior to the termination or expiration of your membership, you will remove all of you and your Members’ property from the Office Space and Premises. After providing you with reasonable notice, we will be entitled to dispose of any property remaining in or on the Office Space or Premises after the termination or expiration of this Agreement and will not have any obligation to store such property, and you waive any claims or demands regarding such property or our handling or disposal of such property. You will be responsible for paying any fees reasonably incurred by us regarding such removal. We have no implied obligations as a trustee, and you hereby safeguard us of any claims of any third parties in respect of such property. Upon the termination or expiration of this Agreement, we will not forward or hold mail or other packages delivered to us.
- ADDITIONAL AGREEMENTS
Mail Service. Member has 5 business days to retrieve their packages, on the 6th business day a storage fee of $5 per day will then apply.
Subsequent mail sent to NuvoDesk Coworking, will be returned to sender if applicable.
User may use the address of NuvoDesk Coworking as his/her/its business address and agrees to make the address format for your business the following:

In the case of NuvoDesk Coworking, & its partners forwarding mail for the Member, NuvoDesk Coworking, will not be responsible for any delay or loss of mail during the forwarding process. NuvoDesk Coworking, will not accept any items exceeding 15 lbs in weight or if it contains any dangerous, live or perishable goods and shall be entitled in its absolute discretion to return uncollected items or refuse to accept any quantity of items it considers unreasonable or unlawful. NuvoDesk Coworking, does not guarantee or assume responsibility for any of the services hereunder. The Member warrants that it will not use any of the rights granted in this Agreement for any obscene, illegal, immoral or defamatory purposes and will not in any way bring NuvoDesk Coworking, into disrepute.
Information Technology. To utilize all the functionalities offered by us, it may be necessary to install software onto a Member’s computer, tablet, mobile device or other electronic equipment. In addition, a Member may request that we troubleshoot problems a Member may have with respect to printing, accessing the network connection or other issues. If we provide such services, we will not be responsible for any damage to your equipment.
Network Connection. NuvoDesk provides shared Internet access to Members via a wireless or wired network connection. Members wishing to implement a private wired network, NuvoDesk may allow you to install a firewall device for your exclusive access and use, subject to NuvoDesk IT approval, and you will be responsible for removal of the same. Prior to any such installation or removal, you shall coordinate with the NuvoDesk IT team to discuss the actual setup, appropriate time, manner and means for such installation or removal and any additional fees that may result from the request. To the extent that we incur any costs in connection with such installation or removal, which are not otherwise paid by you, we shall deduct such costs from the Refundable Deposit. You shall also be responsible for any monthly fees incurred relating to your private, secured wired network.
Waiver of Claims. To the extent permitted by law, you, on your own behalf and on behalf of your Members, employees, agents, guests and invitees, waive any and all claims and rights against us and our affiliates, parents, and successors and each of our and their employees, assignees, officers, agents and directors (collectively, the “NuvoDesk Parties”) and our landlords at the Premises resulting from injury or damage to, or destruction, theft, or loss of, any property, person or pet, except to the extent caused by the gross negligence, willful misconduct or fraud of the NuvoDesk Parties.
Limitation of Liability. To the extent permitted by law, the collective monetary liability of any of the NuvoDesk Parties to you or your Members, employees, agents, guests or invitees for any reason and for all causes of action, will not exceed the total Membership Fees paid by you to us under this Agreement in the twelve (12) months prior to the claim arising. None of the NuvoDesk Parties will be liable under any cause of action, for any indirect, special, incidental, consequential, reliance or punitive damages, or any loss of profits or business interruption. You acknowledge and agree that you may not commence any action or proceeding against any of the NuvoDesk Parties, whether in contract, tort, or otherwise, unless the action, suit, or proceeding is commenced within one (1) year of the cause of action’s accrual. Notwithstanding anything contained in this Agreement to the contrary, you acknowledge and agree that you shall not commence any action or proceeding against any of the NuvoDesk Parties other than the NuvoDesk Party you are directly contracting with hereunder and the assets of such entity for any amounts due or for the performance of any obligations in connection with this Agreement.
Indemnification. You will indemnify the NuvoDesk Parties from and against any and all claims, including third party claims, liabilities, and expenses including reasonable attorneys’ fees, resulting from any breach or alleged breach of this Agreement by you or your Members or your or their guests, invitees or pets or any of your or their actions or omissions, except to the extent a claim results from the gross negligence, willful misconduct or fraud of the NuvoDesk Parties. You are responsible for the actions of and all damages caused by all persons and pets that you, your Members or your or their guests invite to enter any of the Premises, including but not limited to any vendors hired by you that enter the Premises. You shall not make any settlement that requires a materially adverse act or admission by us or imposes any obligation upon any of the NuvoDesk Parties unless you have first obtained our or the relevant NuvoDesk Party’s written consent. None of the NuvoDesk Parties shall be liable for any obligations arising out of a settlement made without its prior written consent.
Insurance. It is at your sole discretion to provide insurance at your own expense during the Term, personal property insurance and commercial general liability insurance covering you and your Members for property loss and damage, injury to your Members and your Members’ guests or pets and prevention of or denial of use of or access to, all or part of the Premises, in form and amount appropriate to your business. In addition, you may consider maintaining, at your own expense during the Term, workers’ compensation insurance providing statutory benefits in accordance with the law and employer’s liability in an amount appropriate to your business.
Pets. Pets are strictly prohibited apart from service animals.
Other Members. We do not control and are not responsible for the actions of other Member Companies, Members, or any other third parties. If a dispute arises between Member Companies, members or their invitees or guests, we shall have no responsibility or obligation to participate, mediate or indemnify any party. Any Member involved in a dispute could be asked to leave the premises for the remainder of the day. These events could also lead to suspension or termination if NuvoDesk can accurately determine who was in the wrong by viewing our security cameras.
Third Party Services. Services do not include, and we are not involved in or liable for, the provision of products or services by third parties (“Third Party Services”) that you may elect to purchase in connection with your Membership, including via the NuvoDesk Market, even if they appear on your NuvoDesk invoice. Third Party Services are provided solely by the applicable third party (“Third Party Service Providers”) and pursuant to separate arrangements between you and the applicable Third-Party Service Providers. These Third-Party Service Providers’ terms and conditions will control with respect to the relevant Third-Party Services. By adding a Member to the Member List, you are thereby authorizing that Member to access and use the NuvoDesk Services
- ARBITRATION AND CLASS ACTION WAIVER
Governing Law. This Agreement and the transactions contemplated hereby shall be governed by and construed under the law of the State of Texas, U.S.A.
Venue. Except that either party may seek equitable or similar relief from any court of competent jurisdiction, any dispute, controversy or claim arising out of or in relation to this Agreement, or at law, or the breach, termination or invalidity of this Agreement, that cannot be settled amicably by agreement of the parties to this Agreement shall be finally settled in accordance with the arbitration rules by one or more arbitrators appointed in accordance with said rules. The place of arbitration shall be Arlington, Texas, U.S.A.
Proceedings. The proceedings shall be confidential and in English. The award rendered shall be final and binding on both parties. Judgment on the award may be entered in any court of competent jurisdiction. In any action, suit or proceeding to enforce rights under this Agreement, the prevailing party shall be entitled to recover, in addition to any other relief awarded, the prevailing party’s reasonable attorneys’ fees and other fees, costs and expenses of every kind in connection with the action, suit or proceeding, any appeal or petition for review, the collection of any award or the enforcement of any order, as determined by the arbitrator(s) or court, as applicable. This Agreement shall be interpreted and construed in the English language, which is the language of the official text of this Agreement.
Class Action Waiver. Any proceeding to resolve or litigate any dispute in any forum will be conducted solely on an individual basis. Neither you nor we will seek to have any dispute heard as a class action or in any other proceeding in which either party acts or offers to act in a representative capacity. No proceeding will be combined with another without the prior written consent of all parties to all affected proceedings. You also agree not to participate in claims brought in a private attorney general or representative capacity, or any consolidated claims involving another person's account if we are a party to the proceeding. YOU ARE GIVING UP YOUR RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER ON ANY CLASS CLAIM YOU MAY HAVE AGAINST US INCLUDING ANY RIGHT TO CLASS ARBITRATION OR ANY CONSOLIDATION OF INDIVIDUAL ARBITRATIONS.
Nature and Relationship of the Parties. The whole of the Premises and Office Space remains in our possession and control. Your agreement with us is a contract for the provision of services and we are giving you the right to share with us the use of the Office Space so that we can provide the Services to you. You and we agree that our relationship is not that of landlord-tenant or lessor-lessee and this Agreement in no way shall be construed as to grant you or any Member any title, easement, lien, possession or related rights in our business, the Premises, the Office Space or anything contained in or on the Premises or Office Space. This Agreement creates no tenancy interest, leasehold estate, or other real property interest. The parties hereto shall each be independent contractors in the performance of their obligations under this Agreement, and this Agreement shall not be deemed to create a ﬁduciary or agency relationship, or partnership or joint venture, for any purpose. You acknowledge and agree that you are entering into this Agreement for the purposes of and in the course of your trade, business and/or profession, and not as a consumer. Neither party will in any way misrepresent our relationship.
Updates to the Agreement. We may update this Agreement occasionally and will provide notice to you of these updates. You will be deemed to have accepted the new terms of the Agreement immediately.
Waiver. Neither party shall be deemed by any act or omission to have waived any of its rights or remedies hereunder unless such waiver is in writing and signed by the waiving party.
Extraordinary Events. NuvoDesk will not be liable for, and will not be considered in default or breach of this Agreement on account of, any delay or failure to perform as required by this Agreement as a result of any causes or conditions that are beyond NuvoDesk’s reasonable control, including without limitation (i) any delays or changes in construction of, or NuvoDesk’s ability to procure any space in, any Premises, and (ii) any delays or failure to perform caused by conditions under the control of our landlord at the applicable Premises.
Compliance with Laws. You hereby always proclaim that you and your Members have conducted and will conduct your operations ethically and in accordance with all applicable laws. You hereby represent and warrant that at all times you and your Members have conducted and will conduct your operations in accordance with all laws that prohibit commercial or public bribery and money laundering (the “Anti-Money Laundering Laws).
Signature. This Agreement may be executed by either handwritten or electronic signature, each of which when executed shall constitute a duplicate original, and each may be delivered by emailing the other party to this Agreement signed scanned document or electronically signed portable document format (pdf) version of the contract (as applicable). Each party agrees to the execution of this Agreement in this manner, and the parties acknowledge that execution in this manner creates a binding contract between the parties on the Effective Date.
PERSONAL INFORMATION. NuvoDesk uses your information to customize your experience on the NuvoDesk Premises and Sites and to facilitate our interactions with you. We will also use information to update you on news and developments at NuvoDesk as it may affect your work with us. If you simply come to NuvoDesk websites to read content, we will use information such as your URL and cookies to provide a good experience, as described above. Except as where necessary to provide services to you, NuvoDesk staff do not typically take note of your personal information; the information is mainly stored on or by our computers, computer networks, servers, tools, and systems. We share only the information necessary for third parties to provide the intended products and services. In some cases, the applications or user interfaces you encounter while on our sites are managed by third parties, who may require that you provide your personal information and who have assured us of their compliance with applicable laws.
No Sale or Leasing of Your Information. We will not disclose your personal information to third parties without your consent. We will not sell or lease your personal information to any third party. We may disclose aggregate demographic and statistical information with our business partners; this information is not specific to the identification of you as an individual.
HOW LONG WE RETAIN YOUR INFORMATION. We keep your personal information for as long as is necessary to provide services to you, and for as long as your Membership with NuvoDesk is active. We will retain and use your information as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements.
PROTECTION OF PERSONAL INFORMATION. We endeavor to protect the personal information we receive, gather and store, by such means as password protection, firewalls, encryption, and other means.
THIRD PARTY WEBSITES. If, in your interactions with the NuvoDesk Sites, you are linked or directed to, or click on, a third party website, we cannot control what information you may provide to that party or that website, or how that party may use or disclose any information you may provide to them. As such, we urge that you exercise caution before providing them with your personal information.
CONSENT TO RECEIVE EMAIL COMMUNICATIONS. We may from time to time send you email communications regarding our business, products or services in response to your use of the NuvoDesk Office Space or Sites, and by providing your email address, you consent to receive such communications. Where required by law, we will request that you opt-in (consent) to receive such communications from us before sending you such information. You may opt out of receiving such communications by contacting us at firstname.lastname@example.org or by using the unsubscribe link(s) in emails we send you.
HOW TO CONTACT US REGARDING YOUR PERSONAL INFORMATION. If you wish to discuss what personal information we may have pertaining to you, or the handling or potential disclosure of the same, or you wish to withdraw consent regarding these matters or to ask us to delete your personal information, you may contact us at email@example.com.
WIRELESS NETWORKING ACCEPTABLE USE POLICY
The wireless network service is provided by the property owners and is completely at their discretion. Your access to the network may be blocked, suspended, or terminated at any time for any reason.
You agree not to use the wireless network for any purpose that is unlawful or otherwise prohibited and you are fully responsible for your use. We may bring legal action to enjoin violations of this Policy and/or to collect damages, if any, caused by violations
The wireless network is provided "as is" without warranties of any kind, either expressed or implied. Accessing another person's computer, computer account, files, or data without permission is prohibited
Users are responsible for ensuring they are running up-to-date anti-virus software on their wireless devices.
The user will not access web sites which contain material that is grossly offensive to us, including clear expressions of bigotry, racism, or hatred.
The user hereby releases the Company from liability for any loss, damage, security infringement, or injury which the user may sustain as a result of being allowed access to the Service. The user agrees to be solely responsible for any such loss, infringement, damage, or injury.
Creating or running programs that are designed to identify security loopholes, to decrypt intentionally secured data, or to gain unauthorized access to any system is prohibited. Using any means to decode or otherwise obtain restricted passwords or access control information is prohibited. Forging the identity of a user or machine in an electronic communication is prohibited. Saturating network or computer resources to the exclusion of another's use, for example, by overloading the network with traffic such as emails or legitimate (file backup or archive) or malicious (denial of service attack) activity, is prohibited.
We reserve the right to change the Service offered, the features of the Service offered, the terms of this Policy, or its system without notice to the user.
GOLF SIMULATOR WAIVER & RELEASE OF LIABILITY
CONSENT, ASSUMPTION OF RISK, RELEASE OF CLAIMS AND COVENANT NOT TO SUE
I, the undersigned party, in consideration of NuvoDesk Coworking granting me access to its Golf Simulator facilities, hereby agree as follows:
- to assume the risk of harm, injury or death to myself or my guests which may arise out of my participation in any manner at NuvoDesk Coworking golf simulator facilities.
- to release and discharge NuvoDesk Coworking and its employees and members from liability for any and all claims and causes of action, of whatsoever kind of nature, which I, or my guests, may have as a result of any harm or injury to ourselves arising from the use of NuvoDesk Coworking Golf Simulator facilities;
- to not institute or prosecute any actions or suits at law or in equity, nor aid any institution or prosecution of any claim, demand, action or cause of action against NuvoDesk Coworking, its employees or members, for any personal injury, property damage, costs or attorneys' fees sustained or that might be sustained by myself or my guests which are related to, resulting from, or connected in any manner with the aforesaid use of NuvoDesk Coworking Golf Simulator facilities;
- that this waiver and release of liability may be pleaded as a complete defense to any action or proceeding that may be brought or instituted by me or my guests or by our respective heirs or legal representative heirs or legal representatives; and
- that I agree to indemnify and save and hold harmless NuvoDesk Coworking, its employees, and members and each of them from any loss, liability, damage, or cost, including reasonable attorney's fees, which arises as a result of our breach of this waiver and release of liability.
I am fully aware of the risks associated with indoor golf, particularly as they exist in the confines of an enclosed indoor area, including the possible reckless conduct of other participants. I have carefully read this agreement, agree to accept any and all inherent risks of property damage, personal injury or death and sign it voluntarily. I agree that this waiver and release of liability is irrevocable and effective as of the date set forth below and for all times that I use NuvoDesk Coworking’s Golf Simulator facilities hereafter.
If you are expecting someone at NuvoDesk, please advise them to check-in at the front desk. We have an iPad they can use to check-in and it’ll text you that they have arrived.
NuvoDesk Coworking is a professional work environment. For liability reasons, we always ask that all children be accompanied by an adult on property. For health reasons, if children are sick, please do not bring them to the office.
Do not under any circumstance let anyone in the building. If they are a Member, they should have an access card for entry to the building.
It is a violation as well as a breach in security to leave the front doors of NuvoDesk propped open for any reason. Member will get one warning, and if caught doing this again, could be terminated. We always want all Members to feel safe while doing work and/or business here.
Only take what is YOURS.
Use the black markers located on the fridge to label your food.
Please eat all food that has any kind of odor out in the dining area. (This is out of respect to Member’s that may have sensitivity to certain smells).
Place RINSED dirty dishes in the dishwasher labeled DIRTY. If it says CLEAN, please leave it alone.
The refrigerators will be cleaned each Friday. Please remove any items that belong to you by then.
There is NO Garbage Disposal in the Kitchen. Please scrape all excess food into trash cans before loading dirty dishes into dishwasher.
Please dispose of any food items in the trash can located in the kitchen.
We have Clorox wipes for our Members. Please grab one and clean your lunch table after use so that others may eat at the table after you.
We do have a vacuum on property to use. Just let us know you need it and return it in a timely manner.
Silverware is located under the toaster oven. Plates & Bowls are in the island in front of the fridge.
Throw your K-Cups away after making your coffee in the Keurig.
If you make a mess on the floor/carpet, notify staff immediately. If it’s after hours or the weekend/ please do you best to clean it up and send the staff an email so we can address it the next business day.
Wipe down the microwave after each use and reset the controls when finished.
Ice Machine is located below microwaves. Please do not place ice scoop in ice. Place it back in the holder on the wall.
All Private office trash may be taken to the East and West Side stairwell trash can. This trash is taken out daily. Fridays please dispose of your trash no later than 2 PM. Make sure all food related trash items go to the kitchen trash can over the weekend.
We ask that Members take large trash items (i.e. boxes) to the dumpster. Boxes must be broken down. Dumpster is located in the back of the building. Open the gate doors to enter the enclosed area to get to dumpster.
Ezeep is our designated vendor for printing at NuvoDesk. It acts as a cloud and emails you when your print job is ready. Each office will receive 1 email/occupant to print from.
All technical issues will be addressed during normal business hours. Please send an email with a description of the issue you are experiencing to firstname.lastname@example.org, and we will have our IT Team resolve it the following business day.

Continuously not following quiet workstation rules could result in termination

Lock up when you are done for the day if you are the only one still in this space
- WELLNESS ROOM
This is a space for resting or for new moms that need to pump. There is only 1 person allowed in the wellness room at a time. If the wellness room is occupied by 2 people, this is a violation of your membership agreement and could lead to termination of your membership.
Please limit your time in the wellness room to 1 hour maximum.
When you exit the wellness room, make sure you left it how you found it.
Please don’t forget to prop it open with the doorstop so that Members know it is vacant.
- CONFERENCE ROOMS
Conference rooms need to be booked in advance using the online portal.
We ask that you utilize the conference room size that best suits your needs.
If your reservation is during the day, you will pick up the Master Key for the conference room NuvoDesk Staff assigns for your meeting. If your meeting is after hours, NuvoDesk Staff will place the meeting on your access card.
Master Key for conference rooms is to be placed in the drop box to the right of the reception area on the wall.
Please do not take any cords or equipment out of the conference rooms or you may be subject to pay for those items.
No hot food in conference rooms. Snacks are approved, but all food trash needs to go to kitchen.
Please do not leave any items behind including dishes or personal belongings.
Make sure to cancel your reservation if your meeting will not take place.
- GOLF SIMULATOR
No Food in the Golf Simulator,
Drinks are allowed with extra care in this room due to the equipment being very costly. Take all glasses back to dishwashers. Do not leave in golf room.
Please refer to NuvoDesk Staff for trouble shooting problems with golf simulator. Do not try to repair any settings on the Trackman.
Pick up all tees, ball, and golf clubs after using this area. Leaving this space a mess could result in a Member losing privileges.
For security reasons, please do not allow Non-Members to use the NuvoDesk Tenant network. All Non-Members should be using the NuvoDesk Guest network. Password: 8177759675

NuvoMarket Place only accepts credit cards.
This is an Honor System. Any Member that does not pay for food/drink items will automatically be suspended or terminated.
